Introduction

Welcome to Chat Surveys (the “Platform”), operated by Kapanza BV (“Kapanza”, “we”, “us”, or “our”). These Terms of Service (the “Terms”) govern your access to and use of our website, application, and related services, including https://chatsurveys.vercel.app/ (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to any part of these Terms, you may not use our Services.

We offer a free plan (currently including 100 credits) and paid subscription plans billed in USD ($) through Stripe on a monthly or annual basis. Taxes (including VAT) may apply depending on your location and will be shown at checkout. Unless required by applicable law, fees are non-refundable.

If you use the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

Use License

We grant you a limited, non-exclusive, revocable license to access and use the Services for lawful purposes only and in accordance with these Terms. You agree not to use the Services in any way that violates any applicable law or regulation, infringes upon the rights of others, or interferes with the operation or security of the Services.

• Do not reproduce, sell, resell, or copy any part of the Services except as expressly permitted
• Do not scrape, spider, or systematically extract data from the Services without our written permission
• Do not reverse engineer, decompile, or attempt to discover the source code or underlying models of the Services
• Do not transmit harmful, malicious, or disruptive code, or attempt to bypass rate limits, credits, or access controls
• Do not attempt to gain unauthorized access to accounts, systems, or data
• Do not use the Services to create or distribute unlawful, deceptive, phishing, or harmful surveys/forms, or to collect personal data without appropriate notice and legal basis

User Responsibilities

As a user, you are responsible for maintaining the confidentiality of your account information and password. You agree to accept responsibility for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

You are responsible for the surveys, forms, prompts, and any content you create or upload using the Services, including any images you embed. You agree that you have all necessary rights and permissions to use that content.

You are also responsible for complying with all laws and regulations applicable to your use of the Services, including privacy and data protection laws. If you collect information from respondents (including personal data), you are responsible for providing appropriate notices and obtaining any required consents.

You must be able to enter into a legally binding contract to use the Services. If you are using the Services as a consumer, nothing in these Terms limits any mandatory consumer rights you may have under applicable law.

Content and Data

You retain ownership of any content you submit to the Services (“User Content”). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, and display your User Content solely as necessary to provide, maintain, and improve the Services.

Some features of the Services may use third-party providers (for example, payment processing through Stripe and analytics through Google Analytics). In addition, certain AI-assisted features may send relevant portions of your instructions and content to third-party large language model providers to process your request. You agree not to submit unlawful content and to avoid sharing sensitive personal data unless you have a lawful basis to do so.

Data retention: while your account is active, we generally store your account data (including surveys, embedded images, and related settings) to provide the Services. If you cancel your subscription or close your account, we may retain your data for a limited period (typically up to 30 days) to allow export, support, fraud prevention, or legal compliance, after which we may delete or anonymize it.

We are not responsible for any loss, theft, or misuse of your data. You are responsible for maintaining backups of any important information.

Limitation of Liability

To the fullest extent permitted by law, Kapanza BV (Chat Surveys) shall not be liable for any indirect, incidental, special, or consequential damages arising from or relating to your use of the Services. This includes loss of data, revenue, profits, goodwill, or business opportunities.

The Services may include AI-assisted features that generate suggestions or automate changes based on your instructions. Outputs may be inaccurate or incomplete. You are responsible for reviewing and validating any results before relying on them.

Disclaimer of Warranties

Our Services are provided “as-is” and “as available” without any warranties, express or implied, to the fullest extent permitted by law. We do not guarantee that the Services will be uninterrupted, error-free, or secure, or that any defects will be corrected. We disclaim all warranties of merchantability, fitness for a particular purpose, and non-infringement to the extent permitted by applicable law.

Termination

We reserve the right to terminate or suspend your account and access to the Services at any time, with or without cause, including if you violate these Terms, misuse the Services, or create risk or possible legal exposure for us. Termination is effective immediately and may include removal of your content from our systems.

Subscription management: if you have a paid subscription, you can manage or cancel it through the Stripe customer portal (accessible via a button in your dashboard). If a subscription payment fails, we may restrict features and suspend access after a short grace period (typically 7–14 days) until payment is resolved.

Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of our services constitutes acceptance of the modified Terms.

Governing Law

These Terms are governed by and construed in accordance with the laws of Belgium, and you irrevocably submit to the exclusive jurisdiction of the courts of Antwerp, Belgium. If you are a consumer residing in the EU/EEA, you may also benefit from mandatory consumer protection laws of your country of residence.
